Terms of Service

Welcome to VibeSwiper ("we," "us," or "our"). These Terms of Service ("Terms") form a legally binding agreement between you ("user," "you," or "your") and VibeSwiper and govern your access to and use of our websites, mobile apps, and services ("Service"). By accessing or using VibeSwiper, you agree to these Terms and our Privacy Policy. If you do not accept these Terms, do not use the Service.

1. Introduction and Eligibility

Acceptance: By creating an account, accessing, or continuing to use the Service, you consent to these Terms, our Privacy Policy, and all additional guidelines posted on the platform.

Eligibility: You must be age 18 or older, or the minimum legal age in your country for participating in real-world or paid events. If over 13 but under 18, you affirm parental consent as required by law.

Updates: We may modify these Terms at any time. Notice of material changes will be posted in-app or on our website. Continued use of VibeSwiper after changes indicates acceptance.

2. Account Registration and Security

Registration: You must provide accurate, current, and complete information during sign up.

Confidentiality: You are responsible for safeguarding your login credentials. Promptly notify us of unauthorized use.

Account Deletion and Recovery: You may request deletion of your account. There is a 30-day grace period after which deletion is permanent.

3. Community Standards, User Conduct, and Content

Acceptable Use: You agree to:

  • Post only lawful, non-offensive, non-infringing content.
  • Abide by all community guidelines, event-specific rules, and third-party agreements.

Event Hosting: As a host, you are responsible for the accuracy, legality, and safety of your event. No fraudulent, misleading, unclear, or unlawful events are allowed.

Event Moderation: We may remove events or content that violate these Terms, including based on user reports or automated review. Repeat violations may result in suspension or ban.

Prohibited Behavior: Strictly forbidden behaviors include, but are not limited to:

  • Harassment, hate speech, impersonation, or spamming
  • Attempts to access non-public areas or data
  • Any illegal activity, including distribution of prohibited content
  • Circumventing platform security or moderation

User-Generated Content:

  • You retain rights to your content but grant VibeSwiper a non-exclusive, royalty-free, worldwide license to use, display, and promote your content in connection with the Service.
  • You are responsible for securing any necessary rights to third-party materials before uploading.

4. Events, Payments, and Payouts

Event Creation: You may create public or private events. All event data (including images, description, location, and pricing) must be accurate and not misleading.

Event Review: Events may be subject to moderation. VibeSwiper reserves the right to remove events with unverified, vague, misleading, inappropriate, unsafe, or suspicious content. Repeated or severe violations may lead to permanent removal.

Participant and Host Responsibilities: Participation in any event is at your own risk. Hosts must comply with all local laws and VibeSwiper's community safety expectations.

Payments and Payouts:

  • All transactions (including tickets and host payouts) are securely processed via Razorpay.
  • VibeSwiper deducts a platform service fee/commission before payout.
  • Payouts to hosts are issued after successful event completion and a fraud/quality assurance window (typically 3–7 business days), subject to KYC and compliance.
  • Hosts must provide valid verification and bank details. Failure to do so may result in delayed or withheld payouts.
  • In cases of event cancellation, host non-compliance, or disputes, payouts may be withheld or reversed.

Refunds and Disputes: Refunds are subject to our Refund Policy. Users may report disputes; VibeSwiper reserves discretion in resolution and final decisions.

5. Data Use, Storage, and Security

Data Storage: All data is managed per our Privacy Policy using secure servers and industry-standard encryption.

User Rights: Users may access, update, or request deletion of their data. See our Privacy Policy for details.

Security: While we take reasonable steps to secure your data, you are responsible for the confidentiality of your account information.

6. Safety and Physical Risk Disclaimer

Platform Scope: VibeSwiper acts as an intermediary for connecting hosts and attendees. We do not organize, supervise, or control events unless explicitly stated.

User Risk: Participation or hosting of real-world events carries inherent risks. You agree and acknowledge that you participate at your own risk.

Liability Limitation: VibeSwiper disclaims all responsibility for injuries, damages, losses, or incidents arising from event participation, except where otherwise required by law.

Reporting and Escalation: Users are encouraged to report unsafe, fraudulent, or inappropriate content, users, or events. VibeSwiper may take disciplinary or remedial action, including account suspension or event removal.

7. Third-Party Services and External Links

Integrations: VibeSwiper integrates with third-party services (e.g., Razorpay for payments, Supabase for data).

External Content: Where you link to or share via third-party platforms, you are bound by those platforms' terms and privacy policies.

No Endorsement: We are not responsible for content, accuracy, or practices of third-party services.

8. Intellectual Property

Our IP: All intellectual property rights in the Service, including but not limited to the design, text, graphics, and underlying software, are owned by Vibe Swiper.

User Content: As noted, you retain ownership of your content but grant us a license to use it. You represent that you have the necessary rights to grant this license.

9. Limitation of Liability and Disclaimers

As Is/As Available: The Service is provided "as is" and "as available." We disclaim all warranties, statutory, express, or implied.

Limitation: In no event will VibeSwiper be liable for indirect, special, incidental, or consequential damages (including loss of profits, goodwill, or data).

10. Indemnity

You agree to indemnify and hold harmless VibeSwiper, its officers, affiliates, partners, and employees against any claims, damages, losses, or expenses arising out of your use of VibeSwiper, violation of these Terms, or infringement of any rights of third parties.

11. Termination

By You: You may terminate your account at any time by following deletion steps. A 30-day recovery period applies.

By VibeSwiper: We may suspend or terminate your account or Service access for violation of these Terms, platform abuse, unsafe conduct, or fraud, or in compliance with legal obligations.

Class Action Waiver: To the fullest extent permitted, you waive the right to participate in class action lawsuits or arbitrations.

12. Miscellaneous

Entire Agreement: These Terms, the Privacy Policy, and referenced documents are the complete agreement between you and VibeSwiper.

Severability: If a term is deemed unenforceable, the remainder remains effective.

No Waiver: Delay or failure to enforce any right is not a waiver.

Assignment: Users may not assign rights under these Terms; we may assign without restriction.

Force Majeure: VibeSwiper is not responsible for delays due to acts beyond our control (e.g., natural disaster, internet disruption).

Notice: Legal notices may be sent by email, in-app notifications, or by post to your registered email or address.
